The Scottish Government’s new Register, aimed at improving transparency on who controls land across Scotland, became active on 1st April 2022. Where the owner or tenant noted in the Scottish property register is not the person with significant control of the land, a RCI needs to be made.

How Lows can help

  • Initial call: From an initial discussion on your particular circumstances, we can asses whether or not a RCI needs to be made.
  • Gathering Information: We gather the personal information that needs to be submitted to the Register and help you to complete and sign the relevant notification forms.
  • Title Information: Each title affected requires it’s own return. We will link each title to the relevant parties exercising control.
  • Registration: We will submit the applications for each recorded person to the Registers of Scotland
  • Notification: We will notify the relevant parties of the application.

Why choose Lows?

  • Consultation: Our initial consultation helps us understand your circumstances and whether RCI applies to them.
  • Review: We will review your titles and set out the relevant ownerships and land involved. We then review it with you, making any necessary adjustments.
  • Registration: We will arrange for signatures and submission of the applications to the Registers of Scotland.
  • Proficiency: We have completed hundreds of RCI applications for our clients and will help you with all aspects of the process.
  • Management: When circumstances change, we can take your instructions to update the RCI within the legislative timeframe.
  • Storage and updates: We provide secure storage for your application and can assist with any updates or changes you may need in the future.

Farmers, landowners and those with land held in trust are particularly affected and need to take the RCI legislation seriously. Our guide on RCI is available here. If the registered owner or tenant fails to disclose the required information, or provides false or misleading information, they will be guilty of a criminal offence and may incur a fine of up to £5,000. All parties involved have a duty to provide the required information and non-compliance is a criminal offence. Take the stress out of the process by contacting us today.
