EXECUTRY ADMINISTRATION

The death of a loved family member or friend can be a time of great stress and uncertainty. We are highly experienced in the administration of estates and with two partners Duncan Hill and Roy Flett specialising in this complex area backed by their skilled paralegal practitioners we deal sensitively and efficiently in the winding up of the smallest or largest of estates.

We deal with cases both where the deceased has made a will or where they have died intestate. Our services will usually involve the initial investigation of the estate, applying to the appropriate court for authority to administer the estate and then ingathering and distributing the estate. We can assist in ingathering estate situated abroad or in paying bequest to beneficiaries abroad.

Executry estates are often liable to tax and wherever possible we will seek to mitigate any tax liability for example by advising beneficiaries of circumstances where a Deed of Family Arrangement can be utilised to amend the terms of the deceased’s will so as to use available tax allowances.

Where tax does fall to be paid we will make appropriate arrangements so that tax is settled at the right time and thus avoiding interest or penalties which could otherwise arise.
